Litigation Guardian program

A litigation guardian acts in the place of a parent going through child protection matters in the Youth Court.

During Child Protection proceedings, the Youth Court may request a litigation guardian be appointed when they feel a parent’s disability is impacting their ability to independently manage their matter.

What is a litigation guardian?
Uniting Communities offers a Litigation Guardian program funded by the Attorney General’s office. During Child Protection proceedings, the Youth Court may request a litigation guardian be appointed when they feel a parent’s disability is impacting their ability to independently manage their matter.
How is a litigation guardian appointed?
Where there are concerns regarding a parent’s capacity to engage in a legal matter due to their disability, the Youth Court may make an order to appoint a litigation guardian to help represent the parent in court proceedings..

What does a litigation guardian do?

 
  • Attends all court hearings related to their appointment.

  • Supports the person to understand the process and proceedings.

  • Liaises with the person’s lawyer or supports them to access legal advice.

  • Supports the individual to engage with the Department for Child Protection and address child protection concerns where possible.

  • Assists the person to access appropriate referral services.

  • Explores the parent’s legal options and advises on how to respond to the court order.

  • Represents the person’s best interests, involving them as much as possible and only making decisions on behalf of the person where necessary.
